The National Democratic Congress (NDC) has intensified its legal fight to ensure the inclusion of Joana Gyan Cudjoe as its parliamentary candidate for Amenfi Central in the upcoming December 7th elections. Following the dismissal of an earlier application by an Accra High Court, the NDC has filed a new application at the Sekondi High Court seeking to lift the existing injunction that prevents Madam Cudjoe from appearing on the ballot.
The controversy stems from an interlocutory injunction secured by dissatisfied individuals following the NDC’s May 13, 2023, parliamentary primaries, where Madam Cudjoe won overwhelmingly. This injunction temporarily restrained her from holding herself out as the duly elected candidate.
In response, the NDC’s Functional Executive Committee annulled the May elections and conducted fresh primaries on September 8, 2024, supervised by the Electoral Commission (EC). Madam Cudjoe again emerged victorious. However, the EC, citing the previous injunction tied to the annulled May 2023 election, disqualified Madam Cudjoe from appearing on the ballot.
The NDC vehemently disputes the EC’s decision, arguing that the September election superseded the May election, rendering the earlier contest irrelevant and reinforcing Madam Cudjoe’s legitimacy. The party views the EC’s decision as a gross display of incompetence and vows to fight for Madam Cudjoe’s inclusion.
The NDC’s legal action in Sekondi aims to vacate the existing injunction and pave the way for Madam Cudjoe’s name and picture to appear on the ballot papers for Amenfi Central. A hearing is scheduled for November 7th, 2024, at the Sekondi High Court.
Meanwhile, the Amenfi Central NDC has expressed strong dissatisfaction with the EC’s decision, characterizing it as “undemocratic, unconstitutional, provocative, and barefacedly instigated.” The party has demanded that the EC restore Madam Cudjoe’s name on the notice of poll and ballot papers, emphasizing that they will not accept the election results unless she is a contender. The NDC’s commitment to fighting for justice and restoring the will of the people underscores the intensity of this legal battle.
